The Legal Information Institute of Cornell University Law School defines a class action as a procedural device that allows one or more individuals (plaintiffs) to collectively file and prosecute a lawsuit for the benefit of a larger group (class) with a common legal claim or grievance.

Other terms associated with class action are class suit and representative action. Historically, this form of lawsuit originated in the United States since the early days and is still predominantly a U.S. phenomenon.

How a class action works

Before a lawsuit is filed, lawyers, like Evan Granowitz, are hired to do research and make depositions. The case is then brought to court and certified as a class action, allowing each member of the class in the same circumstances the opportunity to get redress.

All class members have the right to have equal input, rights to any compensation, and solutions ordered by the court. Thus, upon the direction of the court, the defendants’ lawyers send out notices to be given to all parties involved. The recipient of the notice may have two options – to “opt out” or otherwise. When the former is chosen, the party is not entitled to any damages that could be won in the case.

When the party chooses to participate, a settlement is given and the party is prohibited to take any further action in relation to the case.
