Commercial insurance often involves property insurance, liability insurance, and worker’s compensation insurance.

Property insurance. This type of insurance pays for the businesses’ property losses or damages when accidents such as fire incidents or other calamities occur. Based on the businesses’ needs, owners may decide to acquire additional coverage for this type of insurance including:

• Boiler and machinery insurance
• Debris removal insurance
• Business interruption insurance
• Crime insurance

Liability insurance. This answers to the injuries that businesses cause to third parties. One of the basic cases that lawyers like Evan W. Granowitz of CA-based firm Wolf Group L.A. handle under this policy is medical malpractice where doctors can be sued by their patients if they make a mistake with their diagnosis or in carrying out a particular medical procedure. Once the claim has been proven, the insurance may help settle the litigation.

Workers’ compensation insurance. This policy protects or assists employees should they acquire on-the-job injuries.

As with every agreement, insurance policies are also susceptible to mistakes or discrepancies. BusinessInsurance.com shares the common causes of commercial insurance disputes which include:

1. Communication deficiencies. Experts, like Evan Granowitz of CA, emphasize the importance of regular communication between the policyholder and insurer because it’s one of the basic causes of disputes in terms of insurance coverage.

2. Coverage limits and exclusions. This may involve conflicting interpretations of the contract, actual coverage of the insurance, and lack of clarity on the terms and conditions.

3. Loss assessments. This usually involves the contrasting value of projected and incurred losses.

Evan Granowitz: The apple does not fall far from the tree

Evan Granowitz had no problem in playing his cards right. From the beginning, he knew the track he was set to conquer, and any kind of obstacle cannot deter his inherent professional identity.

He was destined to become a lawyer, and his genes can speak for it.

Granowitz’ grandfather happens to be the 103rd Justice of the Supreme Court of California, the late Justice Marcus Kaufman. Prior to his assignment to the Supreme Court, he served as an Associate Justice of the California Court of Appeals for 17 years. He was then appointed as the Supreme Court Justice from March 1987 up to his retirement in January 1990.

Evan Granowitz had only fond memories of grandfather. “He was our adored ‘Zaidi’,” he said. “His love for us knew no boundaries.”

Apart from sparking propensity, Justice Kaufman also influenced Granowitz’s drive toward seeking excellence in the profession. Kaufman epitomized the highest level of top brass legal practice—so much that they named two awards after him, namely, the Kaufman Campbell Award and the Marcus Kaufman Jurisprudence Award. These awards are given to judges who have demonstrated the highest standards of judicial excellence in the pursuit of justice while exemplifying courtesy, integrity, wisdom, and impartiality.

“We were especially fortunate to have inherited his passion and calling for law,” Evan Granowitz said. In spite of Justice Kaufman’s worldly loss, Granowitz vows to continue his quest for legal excellence by stepping up his practice to match that of his grandfather’s—ushering in a new generation of first-rate law practice.

Evan Granowitz and the deathly tort law

The general populace fears the criminal law mainly because those found guilty of crimes may be punished by either incarceration, government dues, or in exceptional cases, death. For Evan Granowitz, however, tort law must be equally feared and respected, despite the marked reduction in punishment severity.

Tort law is a branch of law that covers civil wrongs—those dealing with personal transgressions such as negligence, fraud, trespassing, and defamation, among others. Under the tort law, if someone experiences physical, legal, or economic harm, he/she is allowed to sue the transgressor for damages. If the defendant is found to be guilty of the tort, he or she will pay the victim to compensate for all the troubles caused. Under the tort law, suits may not comprise a physical injury or distress. As a matter of fact, even noise pollution is litigable under the tort law. Your noisy neighbors have a greater responsibility than what they account themselves for.

Evan Granowitz is a California-licensed lawyer specializing in tort litigation.

However, there are times when the tort law can apply to a case that involve the loss of life yet do not border on criminal law. “Wrongful death” statutes allow family members to file charges on behalf of the person who died. An example is the case of “toxic tort” lawsuits, where a substance—either pharmaceutical drug or dangerous chemical—is allegedly the cause of a person’s injury, sickness, or even death. In this case, since the person who died cannot sue the producer of the substance, his family members can litigate for him or her.

In these cases, especially when someone is up against a giant pharmaceutical company whose product, according to a preponderance of evidence, has been known to have caused ‘wrongful death,’ then a lawyer with a good track record and an extensive civil law experience becomes one’s best asset in facing the legal scuffle.

To be included in Super Lawyers magazine’s Rising Star list is a high honor for an up-and-coming new attorney. It is no surprise, therefore, that Evan Granowitz had gained the coveted position in the short list for the third consecutive year. But exactly what does it take to be a Rising Star?

From Evan Granowitz

Super Lawyers chooses the list of its Rising Stars through a shortlist which begins with lawyers nominating the best attorney less than 40 years of age (or practicing for less than 10 years). These lawyers must have personally witnessed their nominee in action. The team at Super Lawyers then evaluates the career histories, licenses, and conduct of the nominees and grades them based on a predefined point system. The points gathered from the nominees are then tallied, and the lawyers with the highest number of points are named the Rising Stars for the year.
